Full Terms and Conditions
1. Agreement Purpose
AusPath authorizes approved Onboarding Partners to upload candidate information into the AusPath Portal for Australian employer review, interview, and placement.
2. Definitions
Onboarding Partner: You and any staff or contractors under your organization.
AusPath: AusPath Agency Pty Ltd, including staff and contractors.
Employer: Australian companies hiring through AusPath.
Candidate: Professionals submitted by you into the Portal.
Portal: AusPath’s secure online platform for candidate management.
3. Exclusivity of Candidates
Candidates you upload are credited to you for tracking commissions and placement success fees.
AusPath may engage directly with candidates for onboarding meetings, interviews, employment offers, and visa support.
Candidates may receive emails, calls, and online invitations from AusPath staff.
AusPath will not interfere with your rights to commissions or placement fees.
You may not present your uploaded candidates to other employers outside AusPath without prior written consent.
4. Payment Terms
Joining Fee: AUD $990, payable upfront or incrementally (AUD $99 per first 10 candidates).
Candidate Upload Fee: AUD $50 per candidate, payable before the candidate profile goes live.
Platinum Package Commission: 25% of each Platinum Package upgrade.
Placement Success Fee: AUD $250 per candidate who successfully starts employment.
Independent Service Fees: You may charge your candidates for additional onboarding services (e.g., documentation, exam support, relocation assistance).
5. Confidentiality
All information relating to candidates, employers, and AusPath’s operations must be kept strictly confidential.
6. Termination
Either party may terminate with immediate effect if the other commits a material breach not remedied within a reasonable timeframe.
7. Non-Circumvention
You must not bypass AusPath to work directly with employers or clients introduced through AusPath.
8. Intellectual Property
Each party retains their intellectual property rights. Logos, branding, or materials must not be used without written approval.
9. Replacement Guarantee
If a candidate leaves during their probation period, AusPath will attempt to find a suitable replacement at no additional cost.
No additional success fee is payable for replacement candidates.
10. Onboarding Partner Conduct
No misrepresentation of AusPath services or guarantee of job outcomes.
Only approved marketing materials can be used.
Affiliate links or tracking codes (if provided) must be used properly.
Onboarding Partners are independent contractors, not employees of AusPath.
11. Governing Law
This Agreement is governed by the laws of Victoria, Australia.
12. Miscellaneous
This Agreement represents the entire understanding between the parties.
Any changes must be made in writing and signed by both parties.
